DGGI Investigation: GST Refund Recovery Demand

A manufacturing and export business in Dadar faced a DGGI demand to return a previously sanctioned GST refund, with interest, across four years, over ₹200 crore. The refund had been claimed on zero-rated exports under Letter of Undertaking, and the department contested the formula used to compute it.

The defence turned on a genuine ambiguity in the CGST Rules: whether refunds on exports made under an Advance Authorization scheme should follow the standard proportionate formula (Rule 89(4)) or the one-to-one input-output correlation method specific to such exports (Rule 89(4B)), an issue the Gujarat High Court had settled in Filatex India Ltd v. Union of India. Recomputing the eligible refund on that basis reduced the recovery demand to a fraction of the original figure.
